These Terms of Service (“Terms”) are a legal agreement between you and Iraida Bernuy, the individual developer operating Waypoint ADHD Organization (“Waypoint,” “we,” “our,” or “us”), governing your use of the Waypoint mobile app, desktop app, Apple Watch app, website, and contributor web view (collectively, the “Service”).
By downloading, installing, or using Waypoint in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms work alongside our Privacy Policy, which explains how we handle your personal information and is incorporated into these Terms by reference.
You must be at least 13 years old to use Waypoint. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.
You must be a human individual. Accounts created by bots, automated scripts, or for the purpose of bulk data collection are not permitted.
You must have the legal capacity to enter into a binding contract in your jurisdiction. If you are using Waypoint on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
To use most features of Waypoint, you will create an account with your email address and a password. You are responsible for:
You may only have one account per person. Creating multiple accounts to circumvent a ban, to abuse the free trial, or for any other reason is prohibited.
You may delete your account at any time from Settings → Account → Delete Account. See Section 6 for what happens to your data.
Waypoint offers two plans:

All payments are processed through Apple App Store or Google Play Store depending on your platform. We do not directly handle your payment card information — it is stored and processed by Apple or Google under their own terms and privacy policies.
Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You authorize Apple or Google to charge your payment method on file for each renewal.
Prices are in US dollars and may be subject to local taxes depending on your location. We reserve the right to change subscription pricing with at least 30 days' notice. Price changes will not affect your current subscription period — they take effect at your next renewal.
New subscribers to Full Navigation receive a 7-day free trial. During the trial, you have full access to all Full Navigation features at no charge.
At the end of the trial, your subscription automatically converts to a paid plan and your payment method will be charged unless you cancel before the trial ends. Cancellation instructions are in Section 6.
Free trials are available once per Apple ID or Google account. If you have previously subscribed to Full Navigation, you are not eligible for another free trial.
You can cancel your Full Navigation subscription at any time through the platform where you subscribed:
Cancellation takes effect at the end of your current billing period. You retain Full Navigation access until then.
If you delete your account (separate from cancelling your subscription), we delete your personal data within 30 days. See our Privacy Policy for full details.
Waypoint allows you to create, store, and organize content including waypoint titles, notes, attachments, territory names, reflection entries, and other personal information (“Your Content”).
You own Your Content. We do not claim any ownership rights over anything you create in Waypoint. These Terms do not grant us any rights to Your Content except the limited rights necessary to provide the Service.
By using Waypoint, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely for the purpose of operating and improving the Service. This includes syncing your content across your devices and backing it up on Supabase servers.
We will never use Your Content — including your task titles, notes, or reflection entries — for advertising purposes or to train AI models.
You are responsible for Your Content. By creating content in Waypoint, you represent that you have the rights to do so and that it does not violate these Terms or any applicable law.
You can export Your Content at any time from Settings → Account → Export My Data. You can delete Your Content at any time by deleting individual items within the app or by deleting your account.
The Drop Zone feature allows you to share a unique link with other people (“contributors”) who can submit task items to your Drop Zone without creating a Waypoint account.

We are not responsible for the content of Drop Zone submissions between users. If you receive abusive or harassing submissions through your Drop Zone, please contact us at support@waypointapp.cc.
You agree not to use Waypoint to:
We reserve the right to investigate suspected violations of these rules and to take appropriate action, including suspending or terminating accounts as described in Section 14.
The Waypoint app, website, design system, brand marks, logo, and all content we create — including the compass mark, orbit visualization, and all original text — are owned by Iraida Bernuy and protected by copyright, trademark, and other intellectual property laws.
These Terms do not grant you any right to use our name, logo, or brand marks for any purpose without our prior written consent.
If you believe any content on Waypoint infringes your intellectual property rights, please contact us at support@waypointapp.cc with a description of the claimed infringement.
Feedback you provide to us about Waypoint — including bug reports, feature suggestions, and general comments — is given voluntarily. We may use this feedback to improve the Service without any obligation to compensate you or keep it confidential.
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
Location-based features including errand mode depend on your device's GPS, operating system, and connectivity. We cannot guarantee these features will work in all conditions.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
To the maximum extent permitted by applicable law, Iraida Bernuy and Waypoint ADHD Organization shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, loss of goodwill, service interruption, computer damage, or system failure — arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or the Service is limited to the greater of: (a) the amount you paid us in the 12 months before the claim arose, or (b) $10 USD.
Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Iraida Bernuy and Waypoint ADHD Organization from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
You may stop using Waypoint at any time. You can cancel your subscription as described in Section 6 and delete your account from Settings → Account → Delete Account.
We may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms, engaged in abusive behavior, or if required to do so by law. We will provide reasonable notice before doing so unless the violation is severe (such as illegal activity or abuse of other users).
If we terminate your account for a violation of these Terms, you are not entitled to a refund of any subscription fees paid. If we terminate your account for any other reason, we will provide a pro-rated refund through the applicable app store for any unused subscription period.
Upon termination, your right to use the Service immediately ends. Sections 7 (Your Content ownership), 10 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law) survive termination.
These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
Informal resolution first. Before filing any formal claim, you agree to contact us at support@waypointapp.cc and give us 30 days to try to resolve the issue informally. We commit to making a good-faith effort to resolve any dispute.
Binding arbitration. If we cannot resolve a dispute informally, any dispute arising from or relating to these Terms or the Service shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in Georgia. You and we both waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.
Small claims exception. Either party may bring an individual claim in small claims court in lieu of arbitration if the claim qualifies.
If you are a consumer located in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/odr.
We may update these Terms from time to time. When we make material changes, we will:
Your continued use of Waypoint after changes take effect constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
We will never make changes that retroactively reduce your rights with respect to content you have already created, or that increase the fees you pay during a subscription period already in progress.
